2. What do I have to submit, which interface do I have to use, and where can I find it?

The legally regulated procedure varies according to whether you act as a natural person or a firm.

If you act as a firm, keep this in mind:

Act CCXXII of 2015 on the General Rules of Electronic Administration and Trust Services for Business Organisations and Government Decree 451/2016 (XII. 19.) on the Detailed Rules of Electronic Administration makes electronic administration mandatory, therefore, companies and sole proprietors can only initiate procedures electronically.’

As a natural person, you can act electronically, by post, or in person. In case of electronic submission, the Local Government will also stay in contact with you electronically during the procedure.

You have to submit the document titled Application for Notification of Provision of Accommodation Services, which is available at:

It is important to clarify the following:

1. In Budapest’s District 3, in the case of any changes in the purpose or number of the building units, a townscape-related procedure must be conducted in accordance with Paragraph (2) of Section 53 of Local Government Decree No. 36/2017 (IX.29.) on the Protection of the Townscape of ÓBUDA-BÉKÁSMEGYER accepted by the Representative Body of the Local Government of Óbuda-Békásmegyer (hereinafter: ‘TKR’):

“if the purpose of an existing building partly or completely changes and compared to the previous purpose, the land use in accordance with the new purpose leads to the following results:

  1. in accordance with regulatory requirements, it necessitates the establishment of extra parking spaces or loading areas,
  2. changes in the purpose of an apartment which result in the termination of the apartment
  3. the purpose of a building, which previously served other functions, changes into residential,
  4. the planned new purpose involves the sale of alcoholic beverages,
  5. changes in the number of apartments which involve creating multiple apartments from a single one,
  6. change of any purpose into commercial purpose.’

2. In practical terms it means that if you want to apply for a private accommodation licence for a residential property, a townscape-related procedure must be carried out because, in this case, the purpose of the property changes from ‘residential’ to ‘accommodation’. In addition, for example, if you create two smaller residential units with separate entrances from a larger apartment, or you connect two smaller apartments into one apartment with a single entrance, then in these cases, the number of stand-alone building units will also change, and a townscape-related procedure must be carried out as well.

You can find the Local Government Regulation here, you can contact the Urban Planning and Chief Architect’s Office here, and you can download the form from here.

The architectural and technical plan, with requirements outlined in Point B of Annex 11 of the TKR, must be attached to the form titled ‘Application According to Annex 17’.

The administrative time limit is 15 days, and the procedure is free of charge. You can submit the complete documentation through the Office Gate or send it to the info.foepitesz@obuda.hu e-mail address.

You can find a longer summary here.

You must attach the following documents to your application, from which we have highlighted the mandatory ones:

  • floor layout plan (the scaled floor plan of the real estate indicating the dimensions for each room; in case of single airspace premises, indicate the area that is used as room, or the loft, if there is one);
  • a document certifying the existence of the accommodation management software;
  • the qualification document issued by the accommodation qualifying organisation;
  • where applicable, the lease contract, the consent of the usufructuary, and the consent of the owner must be attached as well.

NOTE:

YOU SHOULD SUBMIT THE APPLICATION TO THE LOCAL GOVERNMENT ONLY IF YOU ALREADY HAVE A VALID TAX NUMBER AND STATISTICAL CODE (IF YOU ARE A SOLE PROPRIETOR).
